1. Fields of application and modification of the conditions of sale
These general conditions of sale apply to all orders placed with the company TERAM LOISIRS
TERAM LOISIRS reserves the right to adapt or modify these general conditions of sale at any time. In the event of modification, the general conditions of sale in force on the day of the order will be applied to each order.
2. Our offer
All offers of products, services and delivery terms, at prices indicated in Euros, are valid in mainland France while stocks last.
For orders from the European Union, the VAT rate applied is the same as that of France. You will simply have to pay additional shipping costs which will be indicated to you when choosing the delivery method.
For orders from abroad or the French Overseas Territories, the products will be invoiced excluding taxes and you will have to pay shipping costs calculated according to the country of destination and the weight of the package. Upon receipt of the package, you will have to pay customs duties and local VAT depending on the country of destination. The amount of shipping costs will be indicated to you when choosing the delivery method.

A description with the essential characteristics of the product is present on each item we sell. However, some minimal variations may occur, so it is recommended to contact our customer service if in doubt.
Our teams do what is necessary to provide a faithful image of the products offered for sale through the images or photographs used for their presentation. Variations may nevertheless appear in particular due to technical limitations, color rendering or customer equipment (internet browser, screen used). TERAM LOISIRS therefore recommends that the customer refer to the description of the products appearing on the site to find out their essential characteristics.
Except in the case of a guarantee, any operation between TERAM LOISIRS and its customers, not contested within 7 days following delivery, cannot give rise to a complaint.
3. Validation of orders and electronic signature
The customer acknowledges being informed that his commitment does not require a handwritten or electronic signature, acceptance of these general conditions of sale and the basket order is implemented by the click mechanism.
4. Order
Any order constitutes acceptance of the prices and description of the products available for sale. The contract is formed when the confirmation of your order is issued.
As soon as your order is validated, it will be transmitted to our logistics services for processing.

5. Price
Prices are indicated in euros and take into account the French VAT in force.
6. Payment and security
6.1. By bank card
Payment is made via a secure payment interface. This implies that no banking information can be misused by a third party. Payment by credit card is therefore perfectly secure. TERAM LOISIRS certifies that it does not hold any banking information entered during the order process. Your account will be debited at the time of payment for your order.
Payment security: Your credit card details are encrypted using the TLS (Transport Layer Security) protocol and never pass unencrypted over the network. Payment is made directly to the bank. TERAM LOISIRS has under no circumstances access to these contact details, and does not keep them on its servers. This is why you are asked for them again for each new transaction on our site.

How it works: Payment in 3 or 4 installments by credit card allows you to pay for the order placed on our merchant site as follows:

6.2. Via Paypal
Your payments are made directly on the PayPal website via pages encrypted using the TLS (Transport Layer Security) protocol. TERAM LOISIRS does not under any circumstances have access to your bank details.
6.3. Via bank check
In the case of payment by check, your order is reserved for 7 days. Beyond this period, without receipt of your check, it will be canceled. The order will only be processed upon receipt of your check and after validation. The announced shipping time may vary depending on the time it takes to receive your payment.
Procedure :
· Date your checks with the date of purchase.
· Note the reference of the item ordered on the back of each check.
6.4. Retention of title clause and transfer of ownership
The products remain the property of TERAM LOISIRS until the order has been fully collected.
However, from the date of delivery, the risks of the delivered goods (loss, damage, destruction) are transferred to the customer. Any damage must be reported directly to the carrier.
6.5. Failure to pay
TERAM IMPEX reserves the right to refuse to make a delivery or to honor an order from a consumer who has not fully or partially paid a previous order or with whom a payment dispute is being administered.
6.6. Anti-fraud control
Securing your orders is a major concern. This is why orders are checked before shipping.
As part of this control and in order to combat fraud and the usurpation of means of payment on the Internet, TERAM LOISIRS may ask the customer to provide proof of identity and address. Depending on the date of receipt, the shipping time for your order may be extended.
If the check of these documents proves favorable, the order will be validated. Otherwise or in the event of non-receipt, TERAM LOISIRS reserves the right to cancel the order. It would then be canceled and then refunded.
7. Delivery terms and times
Shipping terms:
TERAM LOISIRS undertakes to ship your order as quickly as possible, however in the event of a stock shortage, the maximum shipping time will be set at 20 working days following the date of your order; beyond this time, we will cancel the order and will refund you.
When ordering several items, the delivery time to be taken into account is the longest. For example, if you order a radiator shipped within 48 hours and a battery shipped within 7 days then the entire order will be shipped within 7 days.
Packages are shipped Monday through Friday, excluding holidays.
Delivery methods:
TERAM LOISIRS offers you 2 delivery methods, for mainland France:

Deliveries are made from Monday to Saturday.
If you are absent during delivery:
· If the size of your package allows it, it will be placed in your mailbox.
· Otherwise, a delivery notice will be left for you, inviting you to collect your package from a post office or relay point near you.
Don't forget to bring your ID!
If you are unable to do so, you also have the option of authorizing a person of your choice to collect your package. This must be provided with a letter of authorization signed by you, and their identity document. Please note, if you do not collect it from the relay point within two weeks, the package will be returned to us.
Deliveries outside France:
For deliveries outside France, delivery costs depend on the destination and will be announced to you when you place your order.
For transport reasons, products cannot be shipped to certain countries as well as Corsica.
Taxes applied to your orders:
For deliveries within the European Union, the country's VAT applies to the order.
For orders to overseas territories and outside the European Union, the products will be invoiced excluding taxes and you will have to pay shipping costs calculated according to the country of destination and the weight of the package. Upon receipt of the package, you will have to pay, in addition, customs duties, VAT and other local taxes, depending on the country of destination:
· All duties and taxes are calculated, by the customs services, on the amount of the order including transport;
· If you choose an "express" carrier, then they will additionally charge you a flat-rate administration fee (generally between €20 and €30), corresponding to the fact that they carry out, by customs delegation, the calculation and the collection of duties and taxes, which saves you time on delivery.
Additional information:
No compensation can be claimed if an item cannot be delivered: either following an unforeseen manufacturing stoppage, or following strikes, accidents, natural disasters, inability to obtain supplies or all other causes beyond our control.
Delivery of orders is impossible on public holidays.

8. Right of withdrawal
If the size of a product ordered on TERAM LOISIRS is not suitable, or if you simply realize that it does not meet your expectations, you have the option of returning it to us for exchange or refund.
Because your satisfaction is our main concern, this operation only requires a few quick steps. 9. Return conditions
9.1 Return the item at your expense within 14 days of receipt of the package.
9.2 Return the item in the box in which it was sent to you or in an identical box (reinforced, same size) if the first has been damaged. Please note, supplier boxes are not made for the transport of goods.
9.3 The product must not have been worn, assembled or used. All labels must be present on the product for the exchange to be accepted. The product must be in perfect condition upon receipt at our premises. We remind you of the importance of protecting the goods well for the return, as they travel under your responsibility.
If the product were to be damaged during the return, making it impossible to be put back on sale, we may go as far as refusing a refund.
9.4 You can exchange your product with another, opt for a credit equivalent to the value of your product, or have it refunded.
9.4.1 Allow on average between 6 and 8 working days (from the date of delivery of the package) for it to reach us and for us to process your request (replacement, credit or refund). The maximum reimbursement period is set at 20 working days.
9.5 The refund will be made after deduction of outward and return shipping costs which remain the responsibility of the buyer. We offer a Go Free shipping policy, however, in the context of a return we will deduct the amount incurred from the shipping costs initially offered, from the amount of the invoice initially paid.

10. Product warranty
10.1. Commercial guarantee
The products sold are covered by a commercial guarantee aimed at guaranteeing their conformity and ensuring the replacement or repair of the goods. It does not cover defects caused by abnormal or faulty use or resulting from a cause unrelated to the intrinsic qualities of the products. For the warranty to be acquired, we ask that the products be installed by a professional. The assembly invoice will then be requested to assert the warranty claim.
10.2. Legal guarantee
Regardless of the guarantee thus granted, TERAM LOISIRS remains liable for defects in conformity of the product with the contract in accordance with articles L.211-4 et seq. of the Consumer Code and for crippling defects, or hidden defects in the item sold, under the conditions provided for in articles 1641 et seq. of the Civil Code and 2232 of the Civil Code. 13. Responsibilities and Dispute Resolution
TERAM LOISIRS cannot be held liable for inconveniences and damages relating to the use of the Internet network, such as a break in service, the presence of computer viruses or external intrusions or more generally any cases qualified as force majeure by the courts.
In the event of a dispute, an amicable solution will be sought before any legal action. A recovery procedure will be initiated by us. This procedure will result in collection costs of a flat rate of €20 per order. Failing this, any legal action will be brought before the competent courts which the plaintiff may seize at his choice: the jurisdiction of the place where the defendant resides, of the place of actual delivery of the thing or of the place of execution of the service. service.

14. Copyrights
According to the law of March 11, 1957, any reproduction, even partial, of all the elements of the TERAM LOISIRS site requires prior written agreement from SASU TERAM IMPEX.
